This is an Art Loan Agreement between the Asheville Art Museum (AAM), Inc. (Borrower) and Artist (Lender). I hereby acknowledge that I am authorized to lend the object(s) submitted to the Asheville Art Museum (AAM), and that I have read and agree to abide by the conditions governing this loan.
About this Call for Artists
1. Inclusion in Asheville Strong: Celebrating Art and Community After Hurricane Helene will be available on a first-come, first-serve basis.
2. The call will remain open until maximum space limitations are reached, as determined by AAM.
3. The Museum is not authorized to facilitate sales on behalf of exhibiting artists but will feature artists’ preferred contact information alongside their work.
4. Asheville Art Museum reserves the Right of Refusal to display any artwork at its discretion.
Requirements for Acceptance and Display
1. One submission per artist.
2. Submitted artwork may not have existing damage, condition issues, or contain organic materials such as raw wool, cotton, untreated wood, etc., to ensure the safety of Museum collections and facilities.
3. Accepted mediums include painting, drawing, printmaking, mixed media, works on paper, photography, sculpture, ceramics, glass, and metal. Due to technical constraints, we are unable to accept digital, video, or sound-based works (Contact Ehren Gerhard, Curatorial Project Manager, at 828.253.3227 x120 with questions).
4. Maximum dimensions are 60×60 inches.
5. Artwork must have proper hanging hardware and be delivered to the Museum ready for display.
Reproduction and Credit
1. If Lender warrants and represents themself as the copyright holder, then Lender hereby grants permission to Borrower to copy and have published images of the object(s) for education, promotional, and other purposes consistent with furthering the mission of the Borrower. This permission is non-exclusive. This permission shall not be construed as permission to grant any commercial use of the object(s).
Transportation & Shipping
1. Artwork must be delivered to the Borrower by the artist or their representative on the designated delivery dates for the exhibition listed above.
2. Lender assumes all costs of packing and transportation of the object(s) to and from Borrower.
3. Object(s) will be returned packed in the same or similar materials as received unless otherwise authorized by Lender or if Borrower considers the original packing materials inadequate for the protection of the object.
Return of Loan
1. Unless otherwise notified in writing, Borrower will release the borrowed object(s) only to Lender or Lender’s legal representative. In cases of uncertainty, Borrower reserves the right to require a Lender/claimant to establish title by proof satisfactory to Borrower.
2. Unless otherwise agreed to in writing, the loan will terminate on the designated pickup dates listed above. If Borrower’s effort to return the object(s) is unsuccessful, then the objects will be maintained at the Lender’s risk and expense for a maximum of two (2) weeks following the termination date of the loan, at which point the object will become the property of Borrower to use or dispose of as it sees fit.
Ownership
1. Lender warrants full title as the sole owner of the object(s) listed on this agreement or as the legal representative of the owner(s). It is the responsibility of the Lender to give prompt notice to Borrower if there is a change in ownership of the object(s) on loan or if there is a change in the identity or address of the Lender.
Care, Preservation, & Exhibition
1. Borrower will exercise the same care with respect to the object(s) as they do in the safekeeping of their own objects. Borrower agrees to protect the object(s) from fire, theft, mishandling, extremes of light, temperature, and humidity while in Borrower’s custody.
2. Lender certifies that the object(s) are in such condition to withstand the ordinary strains of packing, transportation, and handling.
3. Any evidence of damage or loss at time of receipt or while in Borrower’s custody will be reported immediately to Lender by telephone, to be followed up in writing. No repair, restoration, or alteration will be undertaken without Lender’s express written permission.
Insurance
1. Lender elects to maintain their own insurance and shall constitute a release of Borrower from any liability in connection with the object(s).
2. Borrower’s insurance policy contains the usual exclusions for loss or damage due to wear and tear; gradual deterioration; moths, vermin, or inherent vice; damage resulting from any repairing, restoration or retouching process; damage sustained due to such causes as hostile or warlike action in time of peace or war; atomic, nuclear or radioactive force reaction or contamination; insurrection, rebellion, revolution, civil war, usurped power; action taken by governmental authority; or risks or contraband or illegal transportation or trade.
Additional Terms
1. This Agreement shall be binding on all Parties, as well as the respective Parties’ personal representatives, agents, attorneys, heirs, assigns, or successors in interest.
2. This Agreement constitutes the Parties’ entire agreement with respect to the subject matter. Any amendment to the Agreement must be in writing and signed by Lender and Borrower.
Governing Law
In any event of conflict between this Agreement and any documents of the Lender, the terms of this Agreement shall be binding. This agreement shall be construed in accordance with the laws of the State of North Carolina. Venue for any litigation arising hereunder shall lie with the court of appropriate jurisdiction in Buncombe County, North Carolina.
